GENERAL TERMS AND CONDITIONS

INTRODUCTION

Users of the Services offered by Lemon Shop di Marco Ghetti acknowledge and accept these Terms and Conditions.

Online selling contract means a distance contract between a store and a consumer using internet.

These General Terms and Conditions of Sale govern the sale of merchandise (the “Products”) through the website lemonshop.it (the “Site”).

The Products purchased on the Site are sold directly by Lemon Shop di Marco Ghetti, which has its registered office in Lugo (RA), via Baracca 33, VAT number IT02444840397 (the “Seller“).

LIMITATIONS

The Seller offers Products for sale on the Site; its e-commerce business services are available exclusively to its end users, i.e. the “Consumers” or “Customers”.

“Consumer” shall mean any individual who is acting for purposes which are outside his or her trade, business or profession.

The Seller reserves the right not to process orders received from users who are not Consumers and any other order which does not comply with the Site’s business policy.

These General Terms and Conditions of Sale regulate the offer, transmission and acceptance of purchase orders relating to Products on the Site between the users of lemonshop.it and the Seller.

CONDITIONS

  1. 1. SELLER’S RIGHTS

Each order sent constitutes an offer to purchase the Products. Orders are subject to availability and to the Seller’s discretionary acceptance. The order is placed by the confirmation of the same, and is subject to payment of the price, taxes and shipping and further payment fees indicated in the order summary.

lemonshop.it reserves the right not to accept incomplete or improperly filled orders. lemonshop.it also reserves the right not to accept or process orders in the event of unavailability of the Products; where there is a report of, or suspicion of, fraudulent or illegal activity, including suspicion that purchases are being made for commercial purposes.

2. PRICES AND PURCHASING

All prices shown on the Site and related payments and invoices are in Euro and include VAT.

Any shipping cost will be shown on the website and the Customer will have to check it before buying. For foreign delivery, outside of Italy, other additional costs provided by the destination State will be paid by the Customer.

To place an order for the purchase of one or more Products on lemonshop.it, Customers must fill out the online order form and send it electronically to the Seller, following the relevant instructions.

In particular, once an item and its size are chosen, Customers will need to click on the “Add to Cart” button. It is then possible to continue shopping, add more items to the cart or proceed to check-out.

An order shall be deemed submitted when the Seller receives an order form electronically and the order information has been verified as correct. Payment of the product prices and relevant costs for shipping and delivery must be made by using one the procedures indicated on the Site.

3. ORDER COMPLETION

The order will be completed as soon as possible, subject to availability of the product ordered. The Seller shall not be liable for damages suffered as a result of delays in delivery which are not dependent on circumstances foreseen by the parties at the time of the order confirmation.

4.RIGHT OF WITHDRAWAL AND COMPLAINTS

Consumers who, for whatever reason, are not satisfied with their purchase could cancel the purchase without penalty and without specifying the reason within the term of 14 working days from the conclusion of the contract. The withdrawal must be expressed by sending an e-mail to the following address: lemon@lemoshop.it. Within the stipulated period of 14 days, all purchased goods – intact, in their original packaging and without any lack – must be returned to the sender without forgetting the original receipt at the following references: Lemonshop – Via Baracca 33, 48022 Lugo, RA – Italy. Return costs will be borne by the Customer. Until goods delivering to Seller, the company disclaims any responsibility in case of theft, damage or loss of the package during the shipment. After the withdrawal request and the goods delivering, the total amount paid, with the exception of shipping costs and, in case of foreign delivery other additional costs provided by the destination State, will be refunded within a maximum of five working days.
